PRIVACY POLICY
Via Verde Portugal – Gestão de Sistemas Electrónicos de Cobrança, SA (“VVP”), having registered offices at Quinta da Torre da Aguilha, Edifício Brisa, civil parish of São Domingos de Rana, municipality of Cascais, share capital of 1,000,000.00 euros, registered at the Commercial Registry of Cascais, under the single registration and tax identification number 504 656 767, collects personal data from users of the site www.pagamentodeportagens.pt (hereinafter the "Site"), which it processes, as appropriate, as data controller of those personal data and, in other cases, as a subcontractor to those responsible for the processing identified below. In this regard, Via Verde follows a set of measures to protect the data and privacy of users of the Site and the features provided, hereby creating this Privacy Policy for this purpose.
This Privacy Policy is an integral part of the General Conditions of Use of the Site, which together constitute the "Terms of the Site", and regulates the collection and other terms related to the processing of personal data provided by the users of the Site, as well as the exercise of the users rights regarding this data, in accordance with the prevailing personal data protection legislation.
Notwithstanding the content of the Cookies Policy, visiting this site does not, by itself, imply the automatic registration of any personal data that identifies the user. However, Via Verde may subject the access to certain features available through the Site to prior registration, and in these cases this may involve the provision of personal data.
The personal data to be provided by users of the Site will be as follows, depending on the features:
Identification Data: name, mobile phone number including country code.
Billing and Payment Details: tax identification number, tax country, email address, full address and country and ATM reference. In the case of foreign citizens, instead of the national tax identification number, the driving licence number may be collected as an alternative.
Vehicle Data: Registration number of the vehicle.
Transaction Data: information relating to the passage(s) for which you wish to pay the toll(s) (e.g. potential date, time and/or time interval).
Processing of Personal Data
Via Verde is responsible for processing the personal data identified above of users who are its customers (i.e., when they have subscribed to the Via Verde System) and, as well, of users who are not customers, whose data have been provided through the Site for the purposes of user registration, when necessary, and in order to search for amounts owed.
The personal data collected will be processed and stored electronically by Via Verde or entities subcontracted by it and are intended solely to enable the payment of toll charges and associated administrative costs and the placement of roadside assistance invoices. The same data will also be used for the payment of toll charges and associated administrative costs and of roadside assistance invoices, through this Site at the User's initiative.
Via Verde, when making payment features available on the site, will act as a subcontractor of the entities listed below, acting in accordance with the instructions that are transmitted by them and regarding the following personal data:
Concessionaires and Sub-Concessionaires whose toll charges are payable on this Site, particularly with regard to the collection and further processing of the personal data of users who have not subscribed to the Via Verde System.
Operators, as entities responsible for roadside assistance services, in the case of invoicing for roadside assistance.
The personal data made available by users through the site will be kept in a manner that allows their identification only for the period of time necessary for the above-mentioned purposes. Once payment has been made or it is no longer possible, they will be definitively erased with the exception of the search and registration data which will be kept for a period of five years for the purpose of responding to complaints.
Via Verde assumes that the data collected were entered by the respective holder, that their insertion was voluntary and that they are true, up-to-date and accurate.
Under no circumstances will Via Verde collect credit or debit card data, when this is the payment method chosen by the user. This data will be provided directly to the payment service provider by redirection to their website via a secure link.
Rights of Data Subjects
Under the terms of the law, the user is guaranteed the right to access, rectify, erase or limit the data processing, to portability, or to oppose the processing of their personal data, by written request to Via Verde Portugal - Gestão de Sistemas Electrónicos de Cobrança, SA - Quinta Torre da Aguilha - Edifício Brisa - 2785-599 São Domingos de Rana, or to privacidade_VVP@viaverde.pt.
Notwithstanding any other administrative or legal remedy, the user is entitled to submit a complaint to the National Data Protection Commission (CNPD) or to another competent controlling authority pursuant to the law, at any time, should the customer believe that the processing of his or her data by Via Verde violates the prevailing legal arrangements.

Data Communication and Transmission
Via Verde may communicate the personal data of users of the Site to third parties, provided that it has unambiguously obtained the consent of users for this purpose or when:
1. the transmission is made in compliance with a legal obligation, a resolution of the National Commission for Data Protection or a court order; and
2. the communication is carried out to protect the users vital interests.
The entities that are subcontracted by Via Verde and also the entities to whom data is communicated are obliged by Via Verde to implement adequate technical and security measures that meet the requirements set out in prevailing law and in the instructions transmitted to them.
Security Measures
Via Verde will use its best endeavours to protect the personal data of users against unauthorised access through the Internet. To this end, it uses security systems, rules and other procedures in order to guarantee the protection of users' personal data, as well as to prevent unauthorised access to the data, or improper use, disclosure, loss or destruction of such data.
It is, however, the user’s responsibility to ensure that the computer they are using is adequately protected against viruses and other harmful software. In addition, the user should be aware that without the adoption of adequate security measures (e.g. secure browser configuration, up-to-date antivirus software, security barrier software and not using software of dubious origin), the risk of personal data and passwords being accessed by unauthorised third parties is increased.
Please note that whenever data is collected via open networks, such as the Internet, your data may circulate unsecured and there is a risk that it could be viewed and used by unauthorised third parties.
This Privacy Policy may be changed at any time. The changes will be duly publicised on the website http://www.pagamentodeportagens.pt. Should these changes have a substantial impact on customers rights and freedoms, Via Verde shall notify customers of these changes by means of the contact details they have provided.

COOKIES POLICY
What are cookies?
A cookie is a piece of information that is automatically put on computer hard drives when they access certain sites. The cookie only identifies your browser on the server. What type of cookies do we use?
On the Platforms we only use session cookies, which are temporary cookies that remain in the user’s browser cookie file until the user leaves the Platforms and they collect information about how the users interact with the site. The information that is collected lets us identify problems and provide a better browsing experience.
The user can control how the cookies are stored on their device at any time or remove them just by altering the configuration of your browser. As mentioned, you should be aware that altering these configurations may affect the proper operation of the Platforms. The Platforms use cookies to improve your browsing and some of our internet services require you to activate the “cookies enable” option on the browsers in your devices. TERMS OF USE FOR THE WEBSITE "www.pagamentodeportagens.pt"
1. SUBJECT MATTER
1.1. These Terms of Use (hereinafter "Terms of Use") govern the use of the website www.pagamentodeportagens.pt (hereinafter "Website"), made available on the Internet by Via Verde Portugal – Gestão de Sistemas Eletrónicos de Cobrança, SA, having its head office at Quinta da Torre da Aguilha – Edifício Brisa, São Domingos de Rana, registered at the Commercial Registry Office of Cascais, with the single legal entity number and registration number 504656767, with a share capital of €1,000,000 ("Via Verde Portugal").
1.2. Access to or use of the Site implies full and unreserved acceptance by users of these Terms of Use.
2. SCOPE
2.1. Through this Site, Via Verde provides its clients and other users who have not joined the Via Verde System with access to payment methods for toll charges and administrative costs related to the use of road infrastructures, including the following methods (the “Features"):
a) Consultation – consultation/spontaneous payment of the outstanding amounts resulting from (i) toll charges and other associated administrative costs; and (ii) road assistance invoices, by providing the details requested;
b) Registration – payment (i) of toll charges and other associated amounts, through the Website after receiving a notification from Via Verde which will contain a code for the user to register for this purpose.
2.2. Through the Consultation Feature, described in section 2.1(a), and at the express request of the user, any outstanding toll charges and other associated administrative costs for the use of the (Sub)Concessions operated by the following entities may also be consulted: Ascendi, Vialivre and Globalvia.
2.3. If the user requests a consultation under the terms of section 2.2 above and if there are toll charges and other associated administrative costs, the user will be redirected to the websites of each of the responsible entities so that they can make the necessary payments.
2.4. The information about the possible existence of outstanding amounts, for the use of the (Sub)Concessions identified in section 2.2, as well as the information contained in the websites of third parties, as described in section 2.3, will be of the entire responsibility of these entities, and Via Verde Portugal is not responsible for the information presented, namely in what concerns its accuracy and correction.
3. SITE ACCESS CONDITIONS AND FEATURES
3.1. Via Verde may subject the access to certain features available through the Site to prior registration. Registration on the Site must be done by filling in a form, providing certain personal details, which serves as the user's identification.
3.2. The registration mentioned in sections 2.2. and 3.1. above will require a registration code communicated to the User by means of a notification sent by Via Verde Portugal, as well as a password to access the reserved area of the Site, for the user’s exclusive use only. The user must personalise the access password on the first access to the Site; the confidentiality and proper use of such password is the exclusive responsibility of the user. Via Verde Portugal will not be liable for any damage or injury suffered by the User or third parties as a result of the use of the password by third parties.
3.3. Users registered in their own name shall not provide or make their access details public to other people, thus preventing any unauthorised use.
3.4. The user may proceed to settle the outstanding amounts via (i) an ATM reference generated through the Site, (ii) credit card, or (iii) any other payment method that Via Verde Portugal may make available at any time.
4. WEBSITE CONDITIONS OF USE
4.1. You agree that you will use the Features and the entire Site, its content and facilities diligently, lawfully, properly and ethically in accordance with the Terms of Use and in no way disrupt or degrade the continuity, integrity or quality of the resources, content and Features of the Site.
4.2. Accordingly, users undertake, by way of indication only and not exhaustively, to refrain from:
a) using the Website for illicit purposes or effects, contrary to what is established in these Terms of Use, harmful to the rights and interests of third parties or that may damage, render useless, overload or deteriorate the Website or prevent its normal use by other users;
b) carrying out, or attempting to carry out, illegal activities that infringe the rights of Via Verde Portugal, of users of the Website, of other Internet users or of any third parties not listed above;
c) obtaining or attempting to obtain information, messages, graphics, drawings, sound and/or image files, photographs, recordings, software and, in general, any type of material accessible through the website, using for that purpose, means or procedures other than those that have been made available by Via Verde Portugal;
d) making available, transmitting, sending, producing or reproducing any content that infringes any patent, trademark, trade secret, or any other type of copyright of any person, entity or institution;
e) making available, transmitting, sending, producing or reproducing any content that the user does not have the right to use (including, but not limited to, confidential information obtained by virtue of your position or employment);
f) accessing, collecting, storing, making available, transmitting, sending, producing or reproducing in any format, personal information of third parties;
g) making available, transmitting, sending, producing or reproducing, purposely or accidentally, any material that contains software viruses or any other computer code, files or programs whose purpose, even if not achieved, is to interrupt, destroy or limit the functionality of any computer or computer system (hardware or software) or telecommunications equipment;
h) removing any copyright, trademark or proprietary rights notices.
5. RESPONSIBILITY OF THE USER
5.1. The activities described in section 4.2 are prohibited to the user and constitute grounds for immediate suspension or termination, whether partial or definitive, temporary or permanent, of the use of the Site.
5.2. The user acknowledges that they shall use the Site at their own risk and that they are solely responsible for any damage to their computer system and/or equipment or other damage or loss, including loss of or damage to data, resulting from the use of the materials, content or information obtained in any way through the Site.
6. RESPONSIBILITY OF VIA VERDE PORTUGAL
6.1. The Site was prepared for Via Verde Portugal with information from internal and external sources and is made available to users in its current state, and may contain inaccuracies or errors.
6.2. Via Verde is only responsible for damages that the user may suffer as a result of using the Site when such damages can be attributed to Via Verde as a result of its wilful misconduct.
6.3. Via Verde Portugal is not responsible for damages or losses of any kind that may result, as a purely declarative nature and not limited nature, from:
a) Interferences, omissions, interruptions of the electronic communications services necessary to access the Website, computer viruses, and/or disconnections in the operation of the electronic system, in the content or in services provided by third parties, motivated by causes beyond Via Verde Portugal's control and that may determine a lack of availability or continuity in the operation of the Website or produce alterations in the computer system, in electronic documents or in users' files;
b) Delays or blockages in the use caused by deficiencies or overloading of the Internet or other electronic systems, namely, failures in the access to web pages through the Website or of the services associated to it;
c) Action by third parties through illegitimate interferences outside the control of the Site and that are not attributable to Via Verde Portugal, including interferences caused by the knowledge that unauthorised third parties may have of the conditions, characteristics and circumstances of the use that users make of the Site;
d) Possible errors or security deficiencies that may arise from the use, by the user, of a browser with an outdated or insecure version, as well as from the activation of the user access code storage devices in the browser, or from the damages, errors or inaccuracies that may arise from its malfunction;
e) Functioning, availability and accessibility of the Websites to which it refers by means of links, continuity of information, contents and services existing in those sites, quality, lawfulness, reliability and usefulness of the information, contents and services existing on those sites, if applicable.
7. INTELLECTUAL AND INDUSTRIAL PROPERTY
7.1. All the contents of this Site (including, but not limited to, texts, graphics, logos, icons, databases, images, text files, audio, video and software), as well as the software used on the site are property of Via Verde Portugal.
7.2. All the information, contents, software and materials included in the Site and/or the services are protected by national and international industrial and intellectual property regulations. Users may not copy or distribute these materials without the consent of the owner of such rights. Users may use these materials for personal use, provided they do not modify the materials and do not delete the copyright and other proprietary rights information applicable, and they assume full responsibility for the use and storage of the information received by them.
7.3. The reproduction, alteration, copy, use, distribution, commercialisation, public communication or any other use of the information contained in the Site (including its own design, configuration and form of presentation of the Site) which is carried out without the authorisation of Via Verde Portugal, constitutes an infringement of the legislation in force with regard to intellectual property.
8. PERSONAL DATA
The use of this Site does not necessarily imply the provision of personal data. However, access to some Features may involve the collection and processing of personal data, which will be processed as established in the Privacy Policy, available on this Site.
9. AVAILABILITY OF THE SITE AND VALIDITY OF THE TERMS OF USE
9.1. Via Verde Portugal has the exclusive right to, at any time, suspend, partially or totally, access to the Site, in particular for management, maintenance, repair, modification or modernisation operations and to close, permanently or temporarily, partially or totally, at any time, as it deems convenient, the Site or any of the services and/or Features made available through it. Whenever possible, Via Verde Portugal will communicate the termination or suspension of access to the Site.
9.2. Via Verde Portugal reserves the right, at any time, to change, add, update or delete, partially or totally, these Terms of Use, endeavouring, whenever possible, to give prior notice to users.
9.3. You should check the page of these Terms of Use periodically to confirm whether any updates or changes have been made.
9.4. If you do not agree with any of the terms of use, you must not use the Site.
9.5. If any part or provision of these Terms of Use is unenforceable or in conflict with applicable law, the validity of the remaining parts or provisions shall not be affected.

11. APPLICABLE LAW AND JURISDICTION
11.1. These Terms of Use are governed by Portuguese Law.
11.2. For the resolution of any disputes arising from the provision of services under these Terms of Use, the competent court is the district court of Lisbon, to the express exclusion of all others.

It is now possible to consult all outstanding toll payments for motorways or bridges, through a single website, regardless of the operator page that the user is accessing.
In addition to the three entities (Via Verde, Ascendi and Vialivre), which provide dedicated web pages for the purpose of settling outstanding toll payments, as of today, Globalvia/Portvias also has a toll payment portal. It should be noted that in the case of exclusively electronic tolls, tickets registered without an electronic device, carried out by vehicles with national registration, can be regularised under the post-payment regime with CTT, within a maximum period of 15 working days portagens.pt). Only after this period will the records become available on the payment portals.
The fact that, to date, users have not been able to consult all the records regarding the toll fees due for circulation on national motorways or bridges through a single website, has made the entire payment process very difficult, jeopardising the full payment of outstanding amounts.
With the aim of solving and improving the user experience, the aforementioned entities signed a cooperation agreement in order to make the interoperability of payment portals viable. This initiative makes it possible to provide users with an integrated, complete, easy and safely accessible system for consulting and settling toll payments.
In view of the technical complexity associated with the different operating models of each entity, the project shall be carried out in two phases with regard to the service provided to the customer:
- Phase 1 (Currently implemented) – “One-time”consultation, on each portal, of information regarding the tickets to be paid for all national motorways or bridges (payment remains only available on the web page of origin).
- Phase 2 (To be implemented) – “Single” payment, on each portal, of the tickets to be paid for all national motorways or bridges.
From now on, on the web pages of each operator, users can consult their records and check if there are any outstanding amounts. If there are, users will be able to proceed to payment, being redirected to the corresponding portal whenever unpaid amounts have been detected in another participating entity.
This is an essential initiative towards full interoperability, and it is believed that it could significantly improve the user experience.
Once the operationalisation of this first Phase is stabilised, work on Phase 2 is expected to begin in June of this year.
